This Privacy Policy explains how we collect, use, share, and protect personal information in connection with the beRSVP event guest communications platform and the websites and messaging services we operate.

1. Who We Are

beRSVP is a service of AI-Success Enterprises LLC, doing business as beRSVP ("beRSVP," "we," "us," or "our"). We provide software that event hosts and planners use to invite guests, collect RSVPs, and send event-related updates by SMS and email. You can reach us at support@bersvp.com.

2. Who This Policy Applies To

• Event hosts and planners who create an account and use beRSVP to manage an event.
• Guests and recipients who receive invitations, RSVP, or opt in to receive messages.
• Website visitors who browse our pages without submitting information.

When a host uses beRSVP to communicate with their guests, the host determines who is contacted and what is sent. We process that guest information on the host's behalf, and this policy governs how we handle it.

3. Information We Collect

Information you provide

• Contact details — name, and the email address and/or mobile phone number you choose to give us.
• Event information — event name, RSVP responses, guest counts, meal or accessibility preferences, and any notes you submit.
• Consent records — whether you checked the SMS consent box, the exact consent wording shown to you, and the date and time you submitted it.
• Account information — for hosts, login credentials and billing contact details.
• Support correspondence — messages you send us.

Information collected automatically

• Technical data — IP address, browser user-agent string, and timestamp when you submit a form. For SMS opt-ins we retain these as part of the consent record.
• Delivery data — whether a message was delivered, bounced, or was replied to (including STOP and HELP replies).

We do not knowingly collect government identifiers, financial account numbers (payments are handled by our payment processor), or sensitive categories of personal information.

4. How We Use Information

• To deliver the event communications you or your host requested — invitations, RSVP reminders, event details, and day-of logistics updates.
• To send SMS messages only where you have given express written consent, and only for the purposes described in that consent.
• To send transactional email such as sign-up confirmations and RSVP receipts.
• To honor opt-outs and maintain suppression lists.
• To operate, secure, debug, and improve the service.
• To detect and prevent fraud, abuse, and unlawful use.
• To comply with legal obligations and to establish or defend legal claims, including maintaining proof of consent.

We do not sell personal information, and we do not share mobile phone numbers or SMS consent with third parties for their own marketing purposes.

5. Legal Basis for Processing

Where the GDPR or UK GDPR applies, we rely on: consent (SMS messaging and optional communications); performance of a contract (providing the service to hosts and processing RSVPs); legitimate interests (securing the platform, preventing abuse, improving the service); and legal obligation (retaining consent and financial records). You may withdraw consent at any time without affecting processing carried out before withdrawal.

6. How We Share Information

We share personal information only with service providers who process it on our instructions, and only as needed to run the service. The categories of recipients are: messaging and email delivery providers; cloud hosting and infrastructure providers; database and storage providers; payment processors; automated content-assistance (AI) providers; security and fraud-prevention providers; and professional advisors where legally required.

Card details are handled directly by our payment processor; we do not store them. Content processed by automated content-assistance providers through our service is not used by them to train their models.

We may also share information with the event planner or host whose event you responded to, solely so that they can communicate with you about that specific event — this is the service you requested when you opted in. Mobile information and messaging consent are not shared with event planners or hosts for their own marketing or promotional purposes.

We may disclose information when required by law, subpoena, or valid legal process, or to protect the rights, safety, and property of beRSVP, our users, or the public.

If we are involved in a merger, acquisition, or sale of assets, personal information may transfer as part of that transaction. Mobile information and text messaging opt-in data and consent will not be transferred to a successor entity for marketing or promotional purposes, and any successor entity remains bound by the restrictions described in this section.

Mobile information and text messaging opt-in data and consent will not be sold, rented, or shared with third parties or affiliates for marketing or promotional purposes. All sharing categories described above exclude text message originator opt-in data and consent; this information will not be shared with any third party for any purpose other than delivering the messages you requested.

7. SMS Messaging Program

Our SMS messaging program is beRSVP event guest messaging. If you provide your mobile number and check the SMS consent box on our opt-in form, you will receive recurring text messages relating to the event you signed up for.

Message types — event invitations, RSVP reminders, event details, and day-of logistics updates.

• Message frequency varies.
• Message and data rates may apply. Any charges come from your wireless carrier, not from beRSVP.
• Opt-out — Reply STOP to any message to cancel, or HELP for assistance. You may also unsubscribe at https://bersvp.com/sms-opt-in/unsubscribe.

SMS service is available to United States phone numbers only. Consent to receive SMS is not a condition of any purchase.

8. Your Rights and Choices

• SMS opt-out — reply STOP to any message to cancel, or HELP for assistance. You may also use our unsubscribe form.
• Email opt-out — use the unsubscribe link in any email, or contact us.
• Access, correction, deletion, and portability — email support@bersvp.com and we will respond within the time frame the applicable law requires.
• Objection and restriction — where applicable law provides these rights, you may object to or ask us to restrict certain processing.

Note that we retain opt-out and consent records even after a deletion request, because we are legally required to prove that we honored your opt-out. See Section 11.

9. California Privacy Rights (CCPA/CPRA)

If you are a California resident, you have the right to know what personal information we collect, use, and disclose; to request deletion; to request correction; to opt out of sale or sharing; and to limit the use of sensitive personal information. We do not sell or share personal information as those terms are defined by the CCPA/CPRA, and we do not use or disclose sensitive personal information beyond the purposes permitted by law.

The categories we collect are: identifiers (name, email, phone, IP address); commercial information (subscription and transaction records, for hosts); internet or network activity (user-agent, delivery events); and inferences drawn only for service functionality. We collect these for the business purposes described in Section 4 and disclose them to the service providers listed in Section 6.

To exercise a right, email support@bersvp.com. We will verify your request by matching the contact details you provide against our records. You may use an authorized agent. We will not discriminate against you for exercising any privacy right.

10. UK and European Users (GDPR)

Our SMS messaging service is available to United States phone numbers only. We do not send SMS to numbers outside the United States, so the SMS consent described in this policy does not apply to individuals outside the US.

If you are in the UK or the European Economic Area and use our website or email features, you have the rights described in Section 8, plus the right to lodge a complaint with your local supervisory authority. Our services are operated from the United States, so information you provide will be transferred to and processed in the US. Where we transfer personal data out of the UK or EEA, we rely on Standard Contractual Clauses or another lawful transfer mechanism. Contact support@bersvp.com for details.

11. Data Retention

• SMS consent records — retained for four (4) years from the date of consent, to meet the Telephone Consumer Protection Act (TCPA) statute of limitations and carrier audit requirements.
• Financial and billing records — retained for seven (7) years to meet tax and accounting obligations.
• Opt-out and suppression records — retained permanently. We must keep a durable record that you opted out so that we never contact you again.
• Event and RSVP data — retained while the host's account is active, and deleted or anonymized within a reasonable period after account closure.

12. Security

We protect information with TLS encryption in transit, encryption at rest, least-privilege access controls, and hosting on providers that maintain recognized security certifications. No method of transmission or storage is perfectly secure, and we cannot guarantee absolute security. If we become aware of a breach affecting your personal information, we will notify you and any regulator as required by law.

13. Cookies and Similar Technologies

Our public opt-in, privacy, and terms pages set no cookies and run no third-party analytics or advertising trackers. The beRSVP application uses strictly necessary cookies to keep hosts signed in and to protect against cross-site request forgery. We do not use cookies for advertising, and we do not permit third-party behavioral tracking on our properties.

14. Children's Privacy (COPPA)

beRSVP is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us information, contact support@bersvp.com and we will delete it promptly. Hosts must not use beRSVP to collect information directly from children under 13.

15. International Users

beRSVP is operated from the United States and is intended for users in the United States. If you access the service from elsewhere, you do so on your own initiative and are responsible for compliance with local law. Information you provide will be processed in the United States, where privacy laws may differ from those in your country.

16. Changes to This Policy

We may update this policy from time to time. When we do, we revise the "Last updated" date above. If changes are material, we will provide additional notice — by email or a prominent notice on this page — before they take effect. Continued use of the service after an update means you accept the revised policy.
