Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and AI-Success Enterprises LLC, doing business as beRSVP ("beRSVP," "we," "us," or "our"). By using our websites, opt-in forms, or messaging services, you agree to these Terms. If you do not agree, do not use the service.

1. The Service

beRSVP is an event guest communications platform. Event hosts and planners use beRSVP to send invitations, collect RSVPs, and deliver event-related updates to their guests by SMS and email. Guests use beRSVP to respond to those invitations and, where they choose, to receive updates about the event they were invited to.

2. Eligibility and Accounts

You must be at least 18 years old to create a host account, and at least 13 years old to submit information through our forms. Hosts are responsible for the accuracy of their account information, for keeping credentials confidential, and for all activity under their account.

3. Host Responsibilities

If you use beRSVP to contact guests, you represent and warrant that:

You are responsible for your own compliance with the Telephone Consumer Protection Act, CAN-SPAM, and other applicable law regarding the messages you choose to send.

5. SMS Messaging Program Terms

Program name: beRSVP event guest messaging.

Program description. SMS messages are sent only to recipients who have given express written consent by checking the consent box on our opt-in form. By opting in, you consent to receive recurring SMS messages from AI-Success Enterprises LLC dba beRSVP at the number you provided. Message types are event invitations, RSVP reminders, event details, and day-of logistics updates.

How we handle your mobile number and opt-in data is described in our Privacy Policy. Mobile information and text messaging opt-in data and consent are never sold, rented, or shared with third parties or affiliates for marketing or promotional purposes.

You agree to notify us if you give up or change the phone number you provided.

6. Privacy

Our Privacy Policy explains how we handle personal information and is incorporated into these Terms by reference.

7. Fees

Host subscriptions are billed through our payment processor on the plan and billing cycle you select. Fees are non-refundable except where required by law or expressly stated at purchase. We may change pricing on notice; changes take effect at your next renewal. Guests are never charged by beRSVP for receiving messages, though carrier message and data rates may apply.

8. Intellectual Property

The service, including its software, design, and trademarks, is owned by beRSVP and protected by intellectual property law. You retain ownership of the content you submit, and you grant us a limited license to host, process, and transmit it solely to provide the service.

9. Third-Party Services

The service depends on third-party providers for message delivery, hosting, and payments. We are not responsible for outages, delays, or failures caused by those providers or by wireless carriers.

10. Disclaimers

The service is provided "as is" and "as available," without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the service will be uninterrupted, timely, secure, or error-free, or that any specific message will be delivered. Message delivery depends on carrier and recipient device conditions outside our control.

11. Limitation of Liability

To the maximum extent permitted by law, beRSVP will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or business interruption, arising out of or relating to the service, even if advised of the possibility of such damages. Our total aggregate liability for any claim relating to the service will not exceed the greater of (a) the amount you paid us in the twelve (12) months before the event giving rise to the claim, or (b) one hundred US dollars (US $100).

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

12. Indemnification

If you are a host, you agree to indemnify and hold harmless beRSVP and its officers, employees, and agents from any claim, loss, or expense (including reasonable attorneys' fees) arising from your use of the service, the messages you send, or your violation of these Terms or applicable law.

13. Termination

You may stop using the service at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the service. Sections that by their nature should survive termination — including Sections 8, 10, 11, 12, and 14 — will survive.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. You and beRSVP agree that any dispute arising out of or relating to these Terms or the service will be brought exclusively in the state or federal courts located in Florida, and both parties consent to the personal jurisdiction of those courts.

15. Changes to These Terms

We may revise these Terms from time to time. We will update the "Last updated" date above, and for material changes we will give notice before they take effect. Continued use of the service after a change means you accept the revised Terms.
